This Privacy Notice provides essential information about how Buckinghamshire New University (BNU or the University) handles your personal data and the rights you have in relation to how we use your data. 

BNU is a registered data controller and is responsible for looking after the personal data that you provide to us. We are committed to complying with the data protection principles set out in the Data Protection Act 2018 in a clear and transparent way.

This privacy notice explains when and why we collect personal information about you when you attend or deliver a lecture which is captured at BNU using any form of technology and how we will use this information including the ways we might share this with others. It also explains how we keep your information secure and the rights you have in relation to the information we hold about you.

Data collected when a lecture is captured using any form of technology will be used for the purpose of enabling the lecture to be viewed at a later time and date. Lectures captured will be available within the Virtual Learning Environment. Lecturers have the capacity to record, edit and enrich video learning content and live sessions before making it available to students via the relevant module on the system.

We collect and use your information for the following purposes: 

Purpose 1: To record a lecture using audio and video including any discussions which might take place during the lecture. 

Note:  Lecturers will always make students aware that a lecture is about to be recorded at the start of the lecture and refer the individuals to this privacy notice. The lecturer will decide at which point to commence/stop recording. If a student wishes to opt out of a recording, they will be advised to inform the lecturer at the start of the session. Students are advised they can mute microphones and cover/switch off cameras if they do not wish their personal data to be captured. Once a recording has started it will not be possible to opt out. 

The legal bases that we use in order to legally process the information you provide to us is: 

Legitimate Interest Article 6 (1)(f). BNU will process your personal data as necessary for the purposes of the legitimate interests pursued by the controller. The legitimate interest is to appropriately provide students with the opportunity to view lectures which they were either absent for or wish to review for the purposes of learning.. 

  • Purpose 1: to record a lecture using audio and video including any discussions which might take place during the lecture. 

It is in the interests of the University and students to record lectures with students for the benefit of students not in the position to access lectures at the actual time of delivery or if in attendance to view them at a later time and date.

Data collected during a lecture will be used for the purposes of providing an opportunity for the lecture to be viewed at a later time and date as necessary.  

The personal information we collect includes:

  • images (in video recordings)
  • voice (in audio and video recordings)
  • name (if provided)
  • personal opinions
  • actions taken or contributions made (e.g. audience participation)

Most of the information above will have been provided by you and the lecturer and will have been collected through the use of audio and/or video technology devices.

The above lists are not exhaustive but are indicative of the main types of personal information processed by the University about you should you take part in a lecturer which is captured using audio and/or video technologies.

Your personal information will be shared with the organisations listed below. Any information will be disclosed in accordance with the provisions and obligations of the Data Protection Act. Third Party Software Suppliers

Limited personal data will, or may, be shared with contracted third parties to enable the provision of services for the purpose of maintaining health and safety records. This includes:

  • Microsoft 365 software including email, Teams and other Microsoft 365 systems.
  • Panopto for the provision of Lecture Capture
  • Blackboard for the provision of the Virtual Learning Environment (VLE)

Other systems suppliers who provide software services to and on behalf of the University. In all cases, data will only be shared in accordance with data protection legislation. 

 

We may transfer you personal data outside the UK in the following circumstances:

Where we use a cloud-based IT system to hold your data, and the data in the cloud is stored on servers located outside the UK in a country which is not subject to an adequacy decision. In these circumstances we safeguard your data through undertaking appropriate checks on the levels of security offered by the cloud provider and entering into a contract with them which applies protections of the same type and level required by data protection laws within the UK.

Your data will be retained in university systems in accordance with the Records Lifecycle Management Scheme; a summary of which can be accessed at https://bnu.ac.uk/policies.

The following rights apply to the personal data collected in this notice. Please contact dpofficer@bnu.ac.uk  if you wish to exercise your rights: 

  • Right of access to confirmation of processing and copies of your personal data 
  • Right to rectification if personal data we hold about you is incorrect 
  • Right to restrict processing of your personal data 
  • Right to complain to the Information Commissioner’s Office about how we handle your data. 

In some circumstances you also have the following rights: 

  • Right to object to our processing of your personal data 
  • Right to request erasure of your personal data (deletion)
